A recorded statement of facts is almost always requested any time you are involved in an automobile crash. Another reality is if you give this statement without the benefit of a legal representative many of the things you say will be used against you. Claims adjusters take accident statements multiple times per day. They are very good at getting the information they want to support their role. Without the benefit of any attorney these claims adjustors will later work to convince you to agree to a settlement that falls far short of the compensation you are entitled to.
Insurance adjusters all seem very friendly but it’s important to remember whose side they’re on. Anyone giving a recorded statement without an attorney should give as little information as possible. In almost every case, giving a recorded statement to an insurance adjuster before consulting with an attorney is a bad idea. The role of an insurance adjuster is to investigate and determine the extent of an insurer’s liability in connection with a particular claim. To resolve personal injury claims, the adjuster will evaluate the facts they see as important regarding the case and decide what they believe fair compensation should be. They are supposed to base this decision on the victims’ injuries, property damage, or losses. Some of the adjustor’s roles and duties include:
- Investigate, evaluate and resolve insurance claims.
- Review the insurance policy and determine coverage.
- Speak with all of the parties involved and collect their testimony.
- Negotiate a fair settlement with the injured person or their legal representative.
- Ensuring all injury claims are transparent.
- Determine appropriate compensation.
- Meet with claimants’ employers or doctors to uncover fraudulent claims.
In most cases you have no obligation to provide a recorded statement to another insurance company or adjuster.
