A defective drug can be defined as a drug that holds multiple severe and deadly side effects that may outweigh the drug’s positive benefits.

Before a drug is released to the market, it must be cleared by the U.S. Food and Drug Administration (FDA). In many cases some drugs can be released without testing as long as it is “sufficiently similar” to another product. The FDA must be satisfied that the benefit of the drug intended user outweighs its risk.

Sometimes greed for more profits to the drug companies outweigh good judgment and testing may not be as thorough and stringent as necessary. Many of the drugs that have been involved in litigation recently were not extensively tested.
